Terms of Service

1. Acceptance of Terms

By registering for, accessing, or using the Jazisha platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User," "Member," or "You") and Jazisha Technologies Ltd ("Jazisha," "We," "Us," or "Our").

2. Description of Service

Jazisha is a Chama (investment group) management platform that provides tools for:

• Contribution Management: Track and manage member contributions
• Loan Management: Apply for, approve, and track loans
• Welfare Management: Manage welfare contributions and requests
• Merry-Go-Round (MGR): Organize and manage MGR cycles
• Mchango: Manage fundraising campaigns
• Elections: Conduct and manage Chama elections
• Financial Reporting: Generate reports and statements
• Investment Tracking: Track Chama investments and returns

Jazisha is a platform that facilitates Chama management but is not a bank or financial institution. All funds are managed by the individual Chamas.

3. User Obligations

As a user of Jazisha, you agree to:

• Provide accurate and complete information when registering
• Keep your account information updated
• Use the Service in accordance with all applicable laws and regulations
• Respect the privacy and rights of other users
• Be responsible for all activities that occur under your account
• Comply with your Chama's constitution and bylaws
• Make contributions and repay loans as agreed with your Chama

4. Account Security

You are responsible for maintaining the security of your account credentials. You agree to:

• Use a strong password and keep it confidential
• Enable two-factor authentication for enhanced security
• Notify us immediately of any unauthorized use of your account
• Log out of your account after each session, especially on shared devices

5. Financial Transactions

Jazisha facilitates financial transactions between Chama members. You understand and agree that:

• All transactions are between Chama members and are subject to your Chama's constitution
• Jazisha is not a party to any transaction between members
• Jazisha is not responsible for any disputes between members
• M-Pesa transactions are processed through Safaricom's platform and are subject to their terms
• You are responsible for any fees associated with financial transactions
• Jazisha may charge fees for certain services, which will be clearly communicated

6. User Content

You retain ownership of any content you submit to Jazisha. By submitting content, you grant Jazisha a license to:

• Store, display, and share the content as necessary to provide the Service
• Use the content for internal analytics and improvement of the Service
• Display the content to other members of your Chama as intended

You are responsible for ensuring that your content does not violate any third-party rights or applicable laws.

7. Prohibited Activities

You may not use Jazisha to:

• Engage in any illegal activity
• Submit false or misleading information
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service
• Use the Service for money laundering or fraudulent activities
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations

8. Intellectual Property

Jazisha and its content, features, and functionality are owned by Jazisha Technologies Ltd and are protected by intellectual property laws. You may not:

• Copy, modify, or distribute any part of the Service without permission
• Reverse engineer or decompile the Service
• Use the Jazisha name or logo without permission
• Remove any copyright or proprietary notices

9. Termination

We may terminate or suspend your account at any time, without prior notice, if:

• You breach these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• We discontinue the Service

You may terminate your account at any time by contacting us. Upon termination, your access to the Service will be discontinued.

10. Disclaimer of Warranties

Jazisha is provided "as is" and "as available" without warranties of any kind. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your requirements

11. Limitation of Liability

To the maximum extent permitted by law, Jazisha Technologies Ltd shall not be liable for any:

• Direct, indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from unauthorized access to your account
• Damages arising from transactions between Chama members

12. Indemnification

You agree to indemnify and hold Jazisha Technologies Ltd harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your transactions with other Chama members

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify users of any material changes by:

• Posting the updated Terms on this page
• Sending a notification to registered users
• Updating the "Last Updated" date at the top of this page

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
